Terms of Service

These Terms of Service ("Terms") are an agreement between you and Movementgems LLC, a New York limited liability company ("Movementgems," "we," "us," or "our"). They apply to The 6 Week Back Reset and every related product, resource, and service we provide, including our website at movementgems.com and our products sold through Payhip (together, the "Services"). By purchasing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What You Get

The 6 Week Back Reset is a digital educational program. Depending on what you purchase, it may include:

• The 6 Week Back Reset Protocol eBook, including the Flare Up Playbook, and the Quick Start Guide.
• The Gym Program Library, the Home Program Library, and the Gym Program Library Tracker spreadsheet.
• Access to the Movementgems Reset Checklist web app.
• Links to workout templates in the Hevy app and to exercise demonstration videos.
• An audiobook, once released, and future updates and resources we choose to add.

All products are delivered digitally. No physical goods are shipped.

2. Not Medical Advice

Before starting this or any exercise, nutrition, breathwork, or supplement program, consult a qualified healthcare provider, especially if you are pregnant, have a diagnosed spinal condition, recent injury or surgery, a heart condition, high blood pressure, epilepsy, or any other medical condition. Stop immediately and seek medical care if you experience severe or worsening pain, numbness, tingling, weakness, loss of bladder or bowel control, dizziness, chest pain, or shortness of breath. Never ignore professional medical advice or delay seeking it because of something in the Services.

3. Assumption of Risk

Exercise, breathwork, dietary changes, and supplements involve inherent risks, including the risk of injury. You choose which activities to perform, at what intensity, and whether to use any product we mention. By using the Services, you voluntarily assume all risks associated with your participation, to the fullest extent permitted by law.

4. No Guaranteed Results

Everyone's body, history, and circumstances are different. Results described in our materials, including testimonials and personal stories, reflect individual experiences and are not typical or guaranteed. Your results depend on many factors, including your condition, consistency, and effort. The only commitment we make regarding results is the refund guarantee described in our Refund Policy.

5. Eligibility

You must be at least 18 years old to purchase or use the Services.

6. Purchases and Payment

Purchases are made through Payhip, our online store and delivery platform, and payments are processed securely by Stripe or PayPal. Purchases are also subject to Payhip's own terms. Prices are listed in U.S. dollars. Applicable sales tax or VAT is calculated at checkout and, where required by law, collected and paid by Payhip. You agree to provide accurate purchase information and are responsible for any fees charged by your bank or card issuer.

7. Access and Delivery

After purchase, you are taken straight to your download page, where you can access and download your products right away. If you cannot find your purchase, contact us at help@movementgems.com.

8. License and Intellectual Property

All content in the Services, including text, programs, workouts, images, videos, graphics, and the Movementgems name and logo, is owned by Movementgems LLC or its licensors and is protected by copyright and trademark law.

When you purchase, we grant you a limited, personal, non exclusive, non transferable, revocable license to use the materials for your own personal, non commercial use. You may not:

• Share, resell, redistribute, or publicly post the materials or your access.
• Copy or reproduce the materials, except for brief quotations in a review.
• Use the materials to coach, train, or sell programs to others.
• Remove any copyright or ownership notices.

We may revoke access for any violation of this license, without a refund.

9. Third Party Services and Affiliate Links

The Services link to third party apps, websites, and products, such as Hevy, YouTube, Amazon, Momentous, and Eight Sleep. We do not control these third parties and are not responsible for their content, availability, products, or policies. Your use of them is at your own risk and subject to their terms.

Some links are affiliate or referral links. If you buy through them, we may earn a commission or referral benefit at no extra cost to you. We only recommend products we use or believe in.

10. Refunds

Refunds are governed by our Refund Policy, which is part of these Terms.

11. Chargebacks

If you have a problem with your purchase, please contact us at help@movementgems.com before contacting your bank. We will work with you in good faith. If you file a chargeback or payment dispute, we may suspend your access while it is reviewed.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Services will be uninterrupted, error free, or that third party links will remain available.

13. Limitation of Liability

To the fullest extent permitted by law, Movementgems LLC and its owner, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, arising from or related to your use of the Services. Our total liability for any claim related to the Services will not exceed the amount you paid us for the Services. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Movementgems LLC and its owner from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Services or your violation of these Terms.

15. Termination

We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination, including Sections 2, 3, 4, 8, 12, 13, 14, and 17, will survive.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will show a new effective date. Your continued use of the Services after an update means you accept the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Before filing any claim, you agree to contact us at help@movementgems.com and try to resolve the issue informally for at least 30 days. Any claim that is not resolved informally will be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about the Services.

19. 1 on 1 Coaching Waitlist and Credit

1 on 1 coaching is a separate service and is not included in The 6 Week Back Reset. Joining the waitlist does not guarantee a spot or a start date. If you purchased The 6 Week Back Reset and later enroll in 1 on 1 coaching from the waitlist, the amount you paid for The 6 Week Back Reset, excluding taxes, will be credited toward your coaching fee. The credit can be used once, is not transferable, has no cash value, and does not apply if your purchase was refunded. 1 on 1 coaching is governed by its own separate agreement.
